Terms of Service

The website located at goodpresence.io and the Wipe digital footprint scanning service are operated by Good Presence, Inc. d/b/a Wipe (“Company,” “we,” “us,” or “our”), a Delaware corporation. By accessing or using the Site or Service, you agree to be bound by these Terms. If you do not agree, do not use the Site or Service. You must be at least 18 years old to use the Service.

Section 1

Description of Service; No Guarantees

1.1 What Wipe Does

Wipe is an informational service that searches publicly available online sources—including social media platforms, data broker websites, public records databases, and news archives—and compiles results into a report about an individual’s digital footprint. Wipe also facilitates the sending of removal and noindex requests to third-party websites on your behalf.

1.2 No Guarantee of Removal

We make no representation, warranty, or guarantee that any removal request, noindex request, CCPA deletion request, or other communication sent on your behalf will result in the removal, suppression, or modification of any content. All decisions regarding content removal are made solely by the operators of third-party websites over whom we have no control or authority. You acknowledge that removal success rates vary and that many requests will not result in removal.

1.3 No Legal Advice

Nothing in the Service, scan results, or communications from Wipe constitutes legal advice. If you are preparing for bar character and fitness review or any other legal or regulatory proceeding, you should consult a licensed attorney.

Wipe makes no representation that use of the Service will affect the outcome of any bar application, character and fitness determination, background check, employment decision, security clearance, teaching certification, medical licensing, nursing board certification, FINRA licensing, or other proceeding. The Service is informational only.

1.4 AI-Generated Content

Scan results, website content, removal requests, noindex requests, CCPA requests, reputation scores, risk analyses, and related content may be generated or processed in whole or in part using artificial intelligence systems. Such content is not verified by a licensed attorney, investigator, or other professional. Results may be incomplete, inaccurate, or outdated. You agree not to rely on Wipe scan results as the sole basis for any significant personal, professional, or legal decision.

1.5 Scope of Scan

Wipe searches publicly available information only. We do not access private accounts, non-public records, or information that is not reasonably accessible through public search methods. Results represent a snapshot of publicly available information at the time of scan and may not reflect current conditions.

1.6 Authorization

By initiating a scan, you represent and warrant that you are scanning your own digital footprint or have the express written authorization of the individual being scanned to do so on their behalf. You agree not to use the Service to scan any individual without authorization. Unauthorized use of the Service to scan third parties may violate applicable law.

Section 2

Data Collection & Storage

We collect and store the following information:

(a) Account Information

  • Email address (to send scan results and access links)
  • Payment information (processed securely via Stripe; we do not store credit card numbers)

(b) Scan Data

  • Name, email, address, social profiles, and phone number of person scanned
  • Scan results (websites, social media profiles, data broker listings found during scan)
  • Reputation score and analysis
  • Removal requests sent through our platform

(c) Usage Information

  • Number of scans performed
  • Purchase date and access period expiration date
  • Removal request status

Section 3

Data Retention

(a) Active Access Period

Your scan results are stored for 30 days from the date of purchase. During this period you may access your results, run up to 10 rescans of the same individual, and send removal and noindex requests.

(b) After 30 Days

Scan results and findings are automatically deleted after 30 days. Purchase records are retained for accounting and legal compliance purposes. You may purchase a new scan for updated results.

(c) Removal Request Records

Records of removal requests sent on your behalf are retained for 90 days to track verification status, then deleted.

Section 4

How We Use Your Data

We use your information to perform scans, send removal requests on your behalf, provide access to results, send email notifications about scan results and removal status, process payments and refunds, and improve the Service.

We do not sell your data to third parties, share your scan results with anyone other than you, or store your credit card information.

Section 5

Automatic Rescans & Rescan Policy

Each purchase includes 30 days of access, up to 10 rescans of the same individual during that period, and one automatic verification rescan on day 29. The automatic day-29 rescan does not count against your 10-scan limit. After 30 days or 10 scans (whichever occurs first), a new purchase is required for updated results.

Section 6

Removal Requests

When you request removal or noindex through the Service, we send communications on your behalf from removals@goodpresence.io. We track request status for up to 30 days and verify removal status during the day-29 rescan.

As stated in Section 1.2, we cannot guarantee removal success. You authorize us to send such communications on your behalf by initiating a removal request.

Section 7

Data Security

We use encrypted database connections, secure payment processing via Stripe, access-token-gated scan results, and reasonable administrative and technical security measures to protect your data. However, no security system is impenetrable. By using the Service, you acknowledge and accept the inherent risks of transmitting information over the internet.

Section 8

Your Rights

  • Access your scan data during the 30-day window
  • Request deletion of your data before the 30-day expiration
  • Request a refund in accordance with Section 9
  • Export your scan results
  • Opt out of marketing email communications

Section 9

Refund Policy

(a) Refunds Before Scan Completion

If you request a refund before your scan has completed, we will issue a full refund regardless of when the request is made.

(b) Refunds After Scan Completion

After a scan has completed, refunds are available at our sole discretion within 7 days of purchase in cases involving technical failures that materially prevented delivery of the Service, or material inaccuracies in the description of the Service. Dissatisfaction with scan results, including results that are accurate but unwanted, does not entitle you to a refund. We may issue discretionary refunds outside this policy on a case-by-case basis, but no such obligation exists.

(c) No Refunds After 7 Days

No refunds will be issued more than 7 days after the purchase date under any circumstances, except at our sole discretion.

(d) How to Request

Email support@goodpresence.io with your scan ID and the reason for your request.

Disclaimers

THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. COMPANY DOES NOT WARRANT THAT SCAN RESULTS ARE COMPLETE, ACCURATE, CURRENT, OR FREE FROM ERROR. COMPANY DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ACCESS WILL BE UNINTERRUPTED OR ERROR-FREE.

Section 11

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSS, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE FORM OF ACTION, SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00). THE EXISTENCE OF MORE THAN ONE CLAIM SHALL NOT ENLARGE THIS LIMIT.

Section 12

Indemnification

You agree to indemnify, defend, and hold harmless Good Presence, Inc. and its officers, employees, and agents from any claim, demand, liability, or expense, including reasonable attorneys’ fees, arising from your use of the Service, your violation of these Terms, your violation of any applicable law or regulation, or your unauthorized scanning of a third party.

Section 13

Dispute Resolution & Arbitration

(a) Informal Resolution

Before initiating any formal proceeding, you agree to contact us at support@goodpresence.io and attempt to resolve any dispute informally for at least 30 days.

(b) Binding Arbitration

If informal resolution fails, any dispute arising from or related to these Terms or the Service shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules for disputes under $250,000. The Federal Arbitration Act governs this agreement. Arbitration shall be conducted in the county of your residence or via videoconference.

(c) Class Action Waiver

You and Company agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class or representative action. This waiver is non-severable from the arbitration agreement: if it is found unenforceable, the entire arbitration agreement shall be null and void.

(d) Opt-Out

You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing support@goodpresence.io with your name, address, and a clear statement that you are opting out.

(e) Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.

Section 14

Copyright Policy (DMCA)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, submit a written notice to our designated Copyright Agent containing: your signature; identification of the copyrighted work; identification of the allegedly infringing material; your contact information; a statement of good faith belief that the use is unauthorized; and a statement under penalty of perjury that the information is accurate and you are authorized to act.

Section 15

General

(a) Entire Agreement

These Terms constitute the entire agreement between you and Company regarding the Service.

(b) Severability

If any provision is found invalid or unenforceable, the remaining provisions continue in full force.

(c) No Waiver

Failure to enforce any provision shall not constitute a waiver.

(d) Assignment

You may not assign these Terms. Company may assign these Terms freely.

(e) Changes

We may update these Terms at any time. We will notify you of material changes via email. Continued use after changes constitutes acceptance.
